ACTOR AGREEMENT


Film Production Company/Producer is the party who produces film, either a motion picture or serial. In producing, a producer performs negotiation with the actor/ actress who will be the future cast in the film production.
In entering and signing the agreement with an actor, there are clauses need to be noted down:

1. AGREEMENT/ ENGAGEMENT CLAUSE

Prior to appointing an actor/ actress to play a role according to the scenario or script, he/ she should enter an agreement/ engagement with the Film Production Company/ Producer.
When the agreement/ engagement is made, then an artist is obliged to understand and observe the agreement/ engagement draft set up by the Film Production Company painstakingly especially one which is in connection with the right and obligation of both parties, prior to signing.
Things need to be noted down in the agreement clauses are as follows:
a) Term of agreement;
b) Rendered compensation;
c) Facilities provided by the producer;
d) Enclosed the film title;
e) Number of episodes,
One thing should be affirmed in the clause is that an actor shall be under director and/ or film producer’s direction, guidance and counsel

2. TERMS OF AGREEMENT
Terms of actor agreement customarily follows the shooting period. The contract can be made either daily, per episode or until the shooting completion.

3. COMPENSATION
For theatrical film, the starred actor usually ask for guaranteed compensation paid gradually in several weeks while for the television serial film, compensation can be rendered per episode or daily for several episodes.

4. FACILITY
Facility means private facilities such as dressing room, motorcycle, car, travel expenses and costs if shooting is done wherever out of town.

5. EXCLUSIVITY
During the process of shooting, an actor hired by producer in the film can accept any other offer of film-making.

6. PROMOTION
This clause is the exclusive right of producer to make promotional film out of the 30 minute film or less by facilitating the shooting result. The clause also governs trailer production or behind the screen TV program with or without compensation.
In this clause, producer is granted the right to use the actor’s popular name, photographic likeness, voice or artistic in any publication or for other commercial purposes.

7. MERCHANDISING
The producer’s exclusive right shall be construed as the producer’s right of name, photographic likeness, voice and artistic in connection with the commercial value of the film casting. In general, an actor is entitled to 2.5% out of the gross income after 50% deduction of distribution cost.

8. SOUNDTRACK
This clause regulates the producer’s exclusive right to appropriate, license, advertise and publicize the actor’s voice in the soundtrack music album produced.

After the abovementioned terms and conditions are accepted and fulfilled by both parties, he agreement is made in to two copies and sealed with Rp 6,000 seal and then signed. Then, each party holds one copy of the agreement.
