ARTIST MANAGEMENT AGREEMENT IN A GLANCE
Considering the tight competition in the world of entertainment and broadcasting business, the necessity for a management or an artist manager is so much in need. The goal is to provide advice, direction and guidance for further development of the artist’s career starting from personality and attitude building and artist image maintenance.
On the other hand, the function of an artist management is to act as an institution representing the artist in negotiation, supervision, contract drafting with entertainment and broadcasting business community, etc. Therefore, to develop the existence of an artist in the entertainment world, the artist management needs to possess experience and familiarity in the world of entertainment.
Seeing the big role of an artist management, there are rules and hierarchies, provided in agreement clauses, which are obliged to compliance by the two parties. This is due to the convenience in working, either for the artist or for the management. All is for the sake of professionalism in working.
In making and signing an agreement with someone designated as an artist management, there are clauses needed to be noted down:
1. AGREEMENT/ ENGAGEMENT CLAUSE
a) When an artist designated and engaged someone to be his/ her manager, the artist has to make prior agreement/ engagement with the management.
When the agreement/ engagement is made, an artist is obliged to understand and observe meticulously the agreement/ engagement draft set up by the management, particularly the obligation clause as follows :
b) The management obligation is to give advice, direction and guidance for the artist career development;
c) If a work agreement is entered with an entertainment business community, a manager can represent and act as a negotiator in the name of the artist in providing terms obliged to be agreed, either in connection with talent exploitation, work or other services;
d) When the work takes place under the agreed agreement, a manager can supervise the artist’s professional work, and on behalf of the artist, the manager can provide consultation for the entertainment business community to assure whether or not the work performance is pursuant to the agreement;
e) The obligation of a manager is to be available for consultation and discussion with the artist in connection with his/ her career;
f) The limitation of a manager’s authority in publicizing and exploiting artist’s personality is pursuant to the agreed limitation;
g) A manager is due to receive compensation/ share in the form of money as a result from the artist’s monthly earnings, otherwise stated by the two parties. The compensation/ share can be rendered from the artist’s earnings such as acting, concert/ live stage, commercial, merchandise, etc;
h) Other necessary items in further developing the artist’s career.
2. ASSIGNMENT OF POWER OF ATTORNEY
The agreement can also be used by a manager as a power of attorney to act or conduct legal action on behalf of his/ her name, whenever required. On the other hand, the artist can also perform another power of attorney apart from the agreed agreement in compliance to the applicable law.
3. EXCLUSIVITIES OF MANAGEMENT AND ARTIST
In general, the exclusivities of management and artist are as follows:
a) A management is not required to render the exclusive services for one artist; in fact, the service can also be rendered to another artist in similar field.
b) An artist can appoint someone to be his/ her exclusive manager that he/ she cannot enter any agreement and/ or engage with any other management or agent. Due to this reason, the artist is obliged not to perform negotiation, enter a new agreement or canceling the existing agreement without consultation with the designated management.
4. TERMS OF AGREEMENT
The terms of agreement customarily is 3 year long with one time extension in two year time.
If the abovementioned terms and conditions are fulfilled by both parties, the agreement then is made in to two copies and sealed with, Rp 6,000 sea,l and signed. Then, each party hold one copy of the agreement.
